1.1 Welcome to www.compatiblecare.com.au (the “Website”). The Website provides Nursing, Allied Health and Placement Services (the “Services”).

1.2 The Website is operated by CCNA PTY. LTD. (ABN 17 610 517 907). Access to and use of the Website, or any of its associated Products or Services, is provided by CCNA. Please read these terms and conditions (the “Terms”) carefully. By using, browsing and/or reading the Website, you signify that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of the Services, immediately.

1.3 CCNA reserves the right to review and change any of the Terms by updating this page at its sole discretion. When CCNA updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.

2. Acceptance of the Terms

You accept the Terms by remaining on the Website. You may also accept the Terms by clicking to accept or agree where this option is made available to you by CCNA in the user interface.

3. Registration to use the Services

3.1 In order to access the Services, you must first register for an account through the Website (the “Account”).

3.2 As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:

  • Preferred username
  • Mailing address
  • Telephone number
  • Password

3.3 You warrant that any information you give to CCNA in the course of completing the registration process will always be accurate, correct and up to date.

3.4 Once you have completed the registration process, you will be a registered member of the Website (“Member”) and agree to be bound by the Terms.

4. Your obligations as a Member

4.1 As a Member, you agree to comply with the following:

  • Use the Services only for purposes permitted by the Terms and applicable laws.
  • Maintain confidentiality of your password and/or email address. Use by others may result in cancellation of Services.
  • Notify CCNA immediately of any unauthorised use of your password or account.
  • Access and use of the Website is limited, non-transferable and only for your use in relation to CCNA Services.
  • Do not use the Services for unauthorised or illegal purposes.
  • Acknowledge that automated use of the Website or Services is prohibited.

5. Payment

5.1 Payment for Services may be made by:

  • Electronic funds transfer (EFT)
  • Credit Card
  • PayPal
  • Payment Gateway

5.2 All payments are made using Stripe and are subject to Stripe’s terms and conditions.

5.3 You agree you are liable for any costs associated with failed or declined payments.

5.4 CCNA can vary the Services Fee at any time.

6. Refund Policy

CCNA will only provide you with a refund if they are unable to continue to provide the Services or if deemed reasonable by management.

7. Copyright and Intellectual Property

7.1 The Website, Services and related products are protected by copyright. All rights are reserved by CCNA or its contributors.

7.2 All trademarks, service marks and trade names are owned, registered and/or licensed by CCNA. You are granted a limited, revocable licence to use the Website under the Terms.

7.3 CCNA retains all rights, title and interest in the Website and Services. Nothing transfers ownership rights to you.

7.4 You may not broadcast, republish, upload, post, distribute or adapt the Services without prior written consent.

8. Privacy

CCNA takes your privacy seriously. Information provided through your use of the Website and Services is subject to the Privacy Policy available on the Website.

Use of the Website and Services is at your own risk. Everything is provided “as is” and “as available” without warranty.

10. Limitation of Liability

CCNA’s total liability will not exceed the resupply of the Services to you. CCNA will not be liable for indirect, incidental or consequential damages.

You may terminate the Terms by providing 30 days’ notice and closing your accounts. CCNA may terminate if you breach the Terms, are required to by law, or if Services are no longer commercially viable.

12. Indemnity

You agree to indemnify CCNA from any claims, liabilities, costs or damages arising from your use of the Website or breach of the Terms.

13. Dispute Resolution

Parties must attempt to resolve disputes through negotiation and mediation before commencing legal proceedings. Mediation will take place in CCNA Office, Australia.

14. Venue and Jurisdiction

All disputes will be resolved in the courts of Western Australia, Australia.

15. Governing Law

The Terms are governed by the laws of Western Australia, Australia.

16. Independent Legal Advice

Both parties confirm the Terms are fair, reasonable, and entered into with the opportunity to obtain legal advice.

17. Severance

If any part of these Terms is found void or unenforceable, the remainder will remain in force.
